Background Information



1. L&T35A is a simple form of declaration stating that the tenant agrees that the provisions of ss. 24 to 28 of the Landlord and Tenant Act 1954 (LTA 1954) should be excluded. These provisions deal with security of tenure, which is the right of the tenant to stay in their business premises when the lease ends.

2. Following receipt of the L&T35 notice from the Landlord, the tenant should sign L&T35A at least 14 days before the tenancy is granted or the tenant becomes contractually bound.

3. The tenant in signing the L&T35A proposes to enter into an agreement with the landlord to exclude the tenancy from security of tenure. In addition, it states that he or she has received and read the Schedule 1 warning notice and has accepted the consequences of entering into the agreement. The declaration does not need to be independently witnessed.
