Regulatory Reform Act 2001

An Order made under the Regulatory Reform Act 2001 prescribes new forms for use by a landlord and tenant following an agreement to exclude security of tenure or an agreement to surrender a business tenancy under Part 2 of the Landlord and Tenant Act 1954. 
 
•L&T 35 is the formal notice which the landlord serves upon the tenant 14 days before the agreement to exclude security of tenure is signed, warning him or her that the protection afforded under sections 24 to 28 of the 1954 Act will not apply to the business tenancy. 
 
•L&T 35A is the tenant’s declaration that he or she has received and understood the significance of L&T 35. 
 
•If both the landlord and tenant agree to waive the 14 day period, the tenant must use the statutory declaration contained in L&T 35B. 
 
•L&T 36 is the landlord’s formal notice inviting the tenant to agree to surrender his or her business tenancy which also warns the tenant about the potential loss of important rights. 
 
•L&T 36A is the tenant’s declaration that he or she has received L&T 36 and understands its significance. 
 
•Where a statutory declaration is required, because both parties waive the 14 day period of notice, L&T 36B is used instead of L&T 36A. 
 
Separate Regulations have represcribed forms which we already publish under Part 2 of the Landlord and Tenant Act 1954 and which are listed on page 51 of the Oyez Forms Catalogue. 
 
Practitioners must not use existing versions of L&T 25, L&T 25A, L&T 25B,L&T 26, L&T 28, L&T 29 and L&T 30 after 31st May. However, Oyez’s own non-prescribed form of notice L&T 27 can continue to be used because it remains unaffected by these changes. 
 
ALL THE NEW AND AMENDED FORMS WILL BE AVAILABLE BY MID-MAY BUT SHOULD NOT BE USED BEFORE 1ST JUNE.
